This report deals with the analysis carried out on Resolution No. 7 of the file 00581-2019-0-1817-SP-CO-02 issued by the Second Civil Chamber Commercial Subspecialty of the Superior Court of Justice of Lima, which deals with the annulment action filed by the SPECIAL PROJECT OF INFRASTRUCTURE NATIONAL PROVIAS OF THE MINISTRY OF TRANSPORT AND COMMUNICATIONS PROVÍAS NACIONAL against the award dated July 22, 2019 issued in the arbitration against OBRAS DE INGENIERIA SA - OBRAINSA. Through this report, we analyze the problem regarding the motivation that occurs in arbitration awards, which leads to opening a window so that the decision of these arbitration awards can be reviewed externally and check whether it was actually complied with or not with justifying the arbitration award. In this sense, in this report, it is concluded that the absence of reasons in the arbitration award, violates the right to due reason, does not comply with the principle of procedural consistency and ends up being correct to request the annulment of the award through article 63 numeral 1 subsection b) of Legislative Decree 1071. This analysis will be developed in accordance with the doctrinal and jurisprudential review carried out for this report.
