The present investigation seeks to answer the question about the possibility of registering a notarial declaration of domain acquisition prescription in favor of a single spouse. We maintain that the statute of limitations does not respond to the criterion of gratuitousness, on the contrary, in the case in question, it has to do more with the moment in which the usucapion is consolidated. In the same way, regarding the notarial prescription procedure, the title held by the applicant cannot be considered as reliable proof of property rights. For the purposes of usucapion, this will only have probative value to determine with certainty when the calculation of the statute of limitations began. Likewise, apart from this, we do not consider that the criterion on the moment of acquisition should be one that is applied in a general way without taking into account the particularities of each specific case. On the other hand, we maintain that there is also a problem regarding the understanding of the registry qualification of prescription titles, on which the Registry Court has not been able to adopt a unanimous criterion, and that could be saved by the registrars, considering the facts of each specific case, but which unfortunately do not occur.
