¿Prácticas culturales que involucran tortura animal?: un análisis de la Sentencia del Tribunal Constitucional N° 00022-2018-AI/TC

Abstract

El presente trabajo analizará individualmente las prácticas contenidas en la Primera Disposición Complementaria Final de la Ley 30407, Ley de Protección y Bienestar Animal, en el marco de la STC 00022-2018-PI/TC. De esta manera, se pone en cuestión si es que las corridas de toros, peleas de gallos, peleas de toros y otros espectáculos de similar naturaleza tienen protección constitucional. Se desarrollará, en primer lugar, si es que efectivamente son protegidos por el derecho a la identidad cultural. En segundo lugar, que existe un principio constitucional de protección y bienestar animal y que tiene diversas manifestaciones en nuestro ordenamiento. Finalmente, se concluirá con un análisis ponderativo de las normas jurídicas en cuestión.

This paper will analyze individually the practices contained in the First Final Complementary Provision of Law 30407, Law for the Protection and Welfare of Animals, in the framework of STC 00022-2018-PI/TC. In this way, it is questioned whether bullfights, cockfights, bullfighting and other spectacles of similar nature have constitutional protection. It will be developed, firstly, if they are indeed protected by the right to cultural identity. Secondly, that there is a constitutional principle of animal protection and well-being and that it has diverse manifestations in our legal system. Finally, it will conclude with a ponderative analysis of the legal norms in question.
