Abstract: El presente trabajo de investigación tiene como propósito ahondar en el contenido de la
Resolución 1446-2014/SPC-INDECOPI, mediante la cual se dispuso dejar sin efecto la
resolución final de primera instancia y declarar infundada la denuncia por infracción del
artículo 38.1° del Código de Protección y Defensa del Consumidor interpuesta en contra
de la Institución Educativa Privada Divina Providencia y la Congregación de las
Canonesas de la Cruz.
En ese sentido, se evalúa la cuestión referente a si impedir el ingreso a un colegio religioso
a un menor que participa en la liturgia de otra religión, constituye un acto de
discriminación o se encuentra justificado en tanto que esto podría generarle confusión.
Asimismo, se discute materias vinculadas al contenido de la no discriminación religiosa
en el ámbito de protección al consumidor. Asimismo, se plantean críticas sobre el sustento
teórico que se dio a la justificación de la resolución y los efectos que podría traer en la
sociedad al relacionarse con la cohesión social e incluso la democracia.
The purpose of this research work is to delve into the content of Final Resolution 1446- 2014/SPC-INDECOPI, which decided to nullify the final resolution of the first administrative instance and declare unfounded the complaint for violation of article 38.1 of the Código de Protección y Defensasa del Consumidor filed against Insstitución Educativa Divina Providencia Private and Congregación de las Canonesas de la Cruz. In this sense, the matter evaluated in this research is whether rejecting a minor who participates in the liturgy of another religion from entering a religious school, constitutes an act of discrimination or is justified under the assumption that this could generate confusion in the child. Likewise, it is also discussed matters related to the content of the rule of non-discrimination for religious motives in the field of consumer protection are discussed. Finally, criticisms are raised about the theoretical support that was given to the justification of the resolution and the effects that it could have on society as it relates to social cohesion and even democracy itself.
