Sobre el peso de la Ley : La violación de normas como acto de Competencia Desleal y el Ahorro de Costos

Abstract

El presente trabajo pretende explicar el sustento del acto de competencia desleal en la modalidad de violación de normas y, para ellos, de determinaran sus objetivos, elementos típicos y su regulación en el derecho comparado y, en específico, estudiar el elemento de reducción de costos como requisito de este supuesto y, posteriormente, contrastar con el significado de ventajas significativa competitiva. Para ello, se estudiara su regulación en el derecho peruano, su implementación acorde a los objetivos que persigue el Decreto Legislativo 1044 y la lógica del elemento de reducción de costos.

The purpose of this paper is to explain the basis of the act of unfair competition in the form of violation of rules and, for them, to determine its objectives, typical elements and its regulation in comparative law and, specifically, to study the element of cost reduction as a requirement of this assumption and, subsequently, to contrast it with the meaning of significant competitive advantages. For this purpose, its regulation in Peruvian law, its implementation according to the objectives pursued by Legislative Decree 1044 and the logic of the cost reduction element will be studied.
