The legal analysis of the criterion developed by the Tax Court in the case evaluated in Resolution No. 04711-4-2020 object of study throughout this work addresses the problem of our Income Tax regulations in relation to the deduction of interest accrued in phase preoperative, which by virtue of subsection g) of article 37 of the Income Tax Law (hereinafter, ITL) does not establish any quantitative limitation as it does with the undercapitalization rule contained in the first subsection of the same article. In this following scenario: What is the Income Tax rule applied to interest expenses accrued in the pre-operational stage? Base on a normative evaluation and taking into consideration both the position of the doctrine and the study of case law focused on the core of our work, we conclude that is valid to apply the undercapitalization rule to the extent that it does not distort the coherence of the domestic legal system. Due of the Tax Court, we have considered the assumption of application of both paragraphs of article 37 of the ITL responding to What is the procedure that the company that is still in the pre-operational phase should apply? What is the methodology that should be applied by the company that is in the first year of starting production or exploitation, after in the pre-operational phase? In addition, it will also serve to resolve a current question. How could the Court's criterion be transferred from an undercapitalization rule to that of EBITDA? Finally, we Will provide an answer to its impact on the Value Added Tax (hereinafter, VAT), focusing on whether it is logical for the company to be able to use such tax as a tax credit even though it may eventually add a portion of the interest expense for exceeding 30% of the EBITDA?
