In the electricity sector, it has become recurrent for electricity project concessionaires to turn to the Ministry of Energy and Mines to allege the occurrence of events that in their opinion qualify as a fortuitous event or force majeure, in order to free themselves from any liability and see the term of their project extended, thus mitigating the risks and consequences of not achieving the commercial operation of the project on the scheduled date, incurring in any contractual or legal breach and even being faced with the start of a procedure for the expiry of their definitive concession. In this way, concessionaires very often seek to channel any event that impacts the development of their project under the assumption of fortuitous event or force majeure without having previously carried out the legal analysis to determine whether they are facing an extraordinary, unforeseeable and irresistible event. This academic article arises from this daily practice that the author has identified in his professional practice and seeks to analyse the legal concept of fortuitous events and force majeure applied in the electricity sector, as well as to evaluate whether the delays attributable to the State itself qualify within this legal concept.
