Jhojana Rudas Guedes filed a lawsuit against RENIEC requesting the non-application of Article 20 of the Civil Code, because RENIEC conditioned the issuance of her ID card on changing the order of her surnames in her birth certificate, where her mother's surname appears first. She argues that this condition violates her right to identity, as well as her right to equality and non-discrimination based on sex. In this context, this paper will address the analysis of the ruling issued by the Constitutional Court, starting by determining whether RENIEC's interpretation was constitutional or not. Additionally, it will evaluate whether there was a violation of the right to identity, in relation to the name as a dynamic element and the right to personal development, as well as the violation of the right to equality and non-discrimination, analyzed in the context of social and normative progress from a gender perspective. Finally, it will also analyze whether RENIEC respected the parameters of the principle of legality and whether habeas corpus was the appropriate avenue for the plaintiff to demand protection of her rights.
