Abstract: El rubro textil peruano es complejo de comprender debido a la coexistencia de
los modelos de producción. Las empresas make to order enfocan su producción
de inventario de manera personalizada y bajo la exclusiva demanda de sus
clientes. Mientras que las make to stock enfocan su producción de manera
masiva tomando en cuenta una estimación futura de la demanda.
En el presente informe jurídico se realizará una crítica a un caso que inicia con
la denuncia interpuesta por Perucorp Innova S.A.C. (en adelante, Perucorp
Innova) contra Perucorp Lima S.A.C. (en adelante, Perucorp Lima), mediante la
que se alega que Perucorp Lima habría cometido actos de competencia desleal,
en la modalidad de actos de confusión, violación de secretos empresariales y
sabotaje empresarial en perjuicio de Perucorp Innova.
Por lo que, resulta trascendental revisar el Decreto Legislativo N°1044 - Ley
Represión de la Competencia Desleal (en adelante, LRCD), de forma conjunta
con diversa doctrina nacional e internacional, así como jurisprudencia emitida
por INDECOPI para determinar si, efectivamente, dicho perjuicio le fue
ocasionado a Perucorp Innova.
El presente trabajo se dividirá en tres partes: (i) analizar si Perucorp Lima
cometió un acto de confusión indirecta en perjuicio de Perucorp Innova, (ii)
analizar si existe un secreto empresarial conforme a la normativa peruana que
fue divulgado a Perucorp Lima, para así poder establecer si es que se cometió
una violación de secretos empresariales y (iii) analizar si Perucorp Lima cometió
un acto de boicot en perjuicio de Perucorp Innova.
The Peruvian textile industry is complex to understand due to the coexistence of production models. The make to order companies focus their inventory production in a personalized way and under the exclusive demand of their clients. While the make to stock companies focus their production in a massive way taking into account a future estimation of the demand. In this legal report, a case that begins with the complaint filed by Perucorp Innova S.A.C. (hereinafter, Perucorp Innova) against Perucorp Lima S.A.C. (hereinafter, Perucorp Lima), alleging that Perucorp Lima has committed acts of unfair competition, in the form of acts of confusion, violation of business secrets and business sabotage to the detriment of Perucorp Innova, will be criticized. Therefore, it is transcendental to review Legislative Decree No. 1044 - Law for the Repression of Unfair Competition (hereinafter, LRCD), together with diverse national and international doctrine, as well as jurisprudence issued by INDECOPI to determine if such damage was indeed caused to Perucorp Innova. This work will be divided into three parts: (i) to analyze whether Perucorp Lima committed an act of indirect confusion to the detriment of Perucorp Innova, (ii) to analyze whether there is a trade secret under Peruvian law that was disclosed to Perucorp Lima, in order to establish whether a violation of trade secrets was committed and (iii) to analyze whether Perucorp Lima committed an act of boycott to the detriment of Perucorp Innova.
