Abstract: El presente informe jurídico analiza la Resolución N° 0129-2018/SDCINDECOPI,
consumidores.
This legal report analyzes Resolution No. 0129-2018/SDC-INDECOPI, issued by the Specialized Chamber in Defense of Competition of Indecopi, which resolved in second instance the complaint filed by América Móvil against Entel for allegedly committing acts of deception in the dissemination of the advertisements that were part of its advertising campaign “La Yapa“. Therefore, this paper will evaluate whether the decision adopted in such resolution, in which it was concluded that Entel had incurred in the acts of unfair competition denounced, was correct, based on the provisions of the Law for the Repression of Unfair Competition, as well as on the criteria adopted in Indecopi's resolutions. Thus, after the investigation carried out in this report, it will be demonstrated that Entel did incur in acts of deception in the dissemination of the messages that were subject of analysis in the second instance. After a superficial and integral interpretation of the advertising, from the consumer's perspective, the two objective messages in question were identified, which did not respect the principle of truthfulness. On the one hand, one of the messages omitted information that was relevant for the consumer's choice process and, on the other hand, the other message presented false information. Consequently, it will be concluded that both were likely to mislead consumers.
