This research comprehensively analyzes workplace sexual harassment. This with the help of comparative law, to understand how other laws act in this regard and to note that Peru has a similar system, also using statistics from different international and national sources to understand this phenomenon of gender violence together with its causes and consequences. All this to carefully observe our internal regulations regarding the issue, specifically the Regulation of the Law on Prevention and Punishment of Sexual Harassment of Law No. 27942, finding here 6 problems or shortcomings, 4 of them produced by the lack of specialization of the staff in charge of managing the processes of labor sexual harassment in the private sector, as the regulations do not attempt to generate this specialization or to use mechanisms or tools to do so. Therefore, these problems would allow those involved to be harmed in their fundamental rights, such as the right to access justice, since there is no free disposition to go to a second instance, the right to integrity, sexual freedom, dignity, and others. Due to the aforementioned, proposals for solutions are proposed for these very delicate problems that involve a large number of fundamental rights, generating a recommendation for a review and modification of the aforementioned regulation.
