In consumer relations, not only must the supplier comply with the obligations indicated in the Consumer Protection and Defense Code and other regulations, but the consumer must comply with the economic consideration that was established. Now, in a consumer relationship with private universities, the student is expected to pay all of their fees because this is the direct source that these institutions have to generate income. The problem arises when there are students who have payment problems, some even do not comply with the payment obligation and, despite the collection efforts, it is not possible to recover the amount owed. The problem is aggravated for universities due to article 2 of the Family Economy Protection Law of the payment of pensions in public and private institutes, higher schools, universities and postgraduate schools - Law N°29947 since the educational service must be provided in a manner ideal, regardless of whether there may be overdue payment installments. Private universities are in a disadvantageous position since, in some cases, the student withdraws from the educational institution and, consequently, payment will depend on the responsibility of the consumer. The main objective of this work is to determine if the supplier also needs protection in cases where the consumer does not comply with his obligation, while non-payment also affects universities and all those who depend on them.
