Abstract: El presente informe gira en torno al análisis de la posición de la Sala
Especializada de Protección al Consumidor del Instituto Nacional de Defensa del
Consumidor (Indecopi) respecto al hecho de no prestar auxilio a un consumidor
tras sufrir un accidente en el local comercial de un proveedor. Este órgano
resolutivo indica que dicho hecho debe ser abordado bajo el deber de idoneidad,
ya que se busca garantizar las expectativas que tiene el consumidor de recibir
ayuda ante esa situación. Sin embargo, ¿realmente debe analizarse bajo ese
criterio? La autora considera que no, dado que el hecho en cuestión contraviene
el deber general de seguridad, pues al no asistir al consumidor genera en sí un
riesgo injustificado para su salud, lo cual debe ser prioritario en cualquier
evaluación.
Asimismo, en la medida que los denunciados suscribieron un contrato de
asociación en participación, resulta importante desarrollar en detalle lo que
abarca dicho contrato. Al profundizar sus términos y condiciones, permite
determinar con mayor precisión cómo se distribuyen los riesgos y beneficios, y
cuál es el alcance de las responsabilidades de cada uno de los involucrados.
Esto es fundamental para asegurar una evaluación justo y completa de las
circunstancias del caso.
The present report revolves around the analysis of the position of the Specialized Consumer Protection Chamber of the National Institute for the Defense of the Consumer (Indecopi) regarding the failure to assist a consumer after suffering an accident at the commercial premises of a provider. This decision-making body indicates that such an event should be addressed under the duty of suitability, as it seeks to guarantee the consumer's expectations of receiving help in such a situation. However, should it really be analyzed under that criterion? The author considers that it should not, given that the event in question contravenes the general duty of safety, as failing to assist the consumer generates an unjustified risk to their health, which should be a priority in any evaluation.
