This legal report addresses the environmental impacts generated by the transportation of crude oil through the Norperuvian Oil Pipeline (the Pipeline), owned by Petroperu. The main problem lies in the need to update the Environmental Adequacy and Management Program (PAMA) of this ongoing economic activity, a corrective instrument of which its Environmental Management Plan (PMA) has not been comprehensively revised since 1995. Oil spills in 2016 caused serious damage to the environment and local communities, leaving in evidence the obsolescence of the Pipeline's PAMA and the absence of adequate environmental regulation for its update in the hydrocarbons subsector. The report examines the regulatory complexity of the pronouncement of the Environmental Oversight Tribunal (the Tribunal), which ordered Petroperu to present the update of its PAMA. To do so, it analyzes environmental regulatory instruments such as the National Environmental Impact Assessment System (SEIA) and the Regulations for Environmental Protection in Hydrocarbon Activities (RPAAH). Although the updating of corrective instruments in the hydrocarbons subsector is not explicitly regulated, it is argued that it is essential to ensure the environmental viability of economic activities. The conclusions underline the urgency of updating Petroperu's PAMA to mitigate environmental impacts and protect the health of communities. It is proposed to adopt clear and effective regulatory measures to ensure the sustainability of hydrocarbon transportation activities. In addition, the need for a sectoral regulatory framework with specific procedures for updating preventive and corrective Environmental Management Instruments (IGA) is highlighted, ensuring that they are adapted to the new regulatory and environmental requirements.
