Abstract: Este informe jurídico aborda los impactos ambientales generados por el
transporte de petróleo crudo a través del Oleoducto Norperuano (el Oleoducto),
de titularidad de Petroperú. El problema principal radica en la necesidad de
actualizar el Programa de Adecuación y Manejo Ambiental (PAMA) de esta
actividad económica en curso, un instrumento correctivo del cual su Plan de
Manejo Ambiental (PMA) no ha sido revisado integralmente desde el año 1995.
Los derrames de petróleo en 2016 causaron graves daños al medio ambiente y
a las comunidades locales, dejando en evidencia la obsolescencia del PAMA del
Oleoducto y la ausencia de una regulación ambiental adecuada para su
actualización en el subsector hidrocarburos.
El informe examina la complejidad normativa del pronunciamiento del Tribunal
de Fiscalización Ambiental (el Tribunal), que ordenó a Petroperú presentar la
actualización de su PAMA. Para ello, se analizan instrumentos normativos
ambientales como el Sistema Nacional de Evaluación de Impacto Ambiental
(SEIA) y el Reglamento para la Protección Ambiental en las Actividades de
Hidrocarburos (RPAAH). Aunque no está explícitamente regulada la
actualización de instrumentos correctivos en el subsector hidrocarburos, se
argumenta que es esencial para asegurar la viabilidad ambiental de las

The report examines the regulatory complexity of the pronouncement of the Environmental Oversight Tribunal (the Tribunal), which ordered Petroperu to present the update of its PAMA. To do so, it analyzes environmental regulatory instruments such as the National Environmental Impact Assessment System (SEIA) and the Regulations for Environmental Protection in Hydrocarbon Activities (RPAAH). Although the updating of corrective instruments in the hydrocarbons subsector is not explicitly regulated, it is argued that it is essential to ensure the environmental viability of economic activities.
