In recent years, the Registry Court has ruled favorably, through different resolutions, on the possibility that an association may include in its bylaw the performance of economic and / or lucrative activities without altering its non-profit purpose. These resolutions have been given within the framework of the registration of the constitution of an association (which includes the content of its bylaw) in the Registry of Legal Entity of the National Superintendency of Public Registries. In this sense, since there are still doctrinal positions that are in disagreement with the registration of the constitution of an association because it includes within its bylaw the possibility of carrying out economic and / or lucrative activities for its support and development its non-profit purpose, we have considered elaborate this article. Thus, in this document, we will focus on the implications of carrying out economic and / or lucrative activities for an association (positive and / or negative) as means to achieve its purpose, as well as the context in which these are given and how they are carried out (representatives). Also, it will seek to provide support to those who draft the bylaws of an association (founders) so that they may suffer observations from the public registrars. Finally, a proposal to modify article 82 of the Civil Code will be provided in order to solve the question.
