The objective of this Report is to analyze the arguments provided by the jurisdictional authority in Labor Cassation No. 4936-2014-Callao. In the ruling, the authority explores the possibility that, in the face of the denaturalization of the employment contracts subject to a specific service modality -signed between the plaintiff and Lima Airport Partners S.R.L.-; and, the subsequent signing of innominate employment contracts -under the article 82 of the Labor Productivity and Competitiveness Law-, where a resolutive condition was included as a cause for termination of the employment relationship, this has effects on the employment relationship already denaturalized. The method to carry out the analysis of the resolution will be based on the development of the facts indicated in each of the procedural instances, in order to be able to apply the pertinent regulations and thus demonstrate that, in the present case, the ruling provided by the authority was not adequate. Thus, the main conclusion is that the resolutive condition agreed between LAP and the plaintiffs did not comply with the copulative elements of the legal act, despite being a modality of the legal act.
