The supplementary term of the investigation in criminal proceedings allows the judge to extend the term exceptionally in the event of an opposition to the request for dismissal, and this should be granted after evaluating the jurisprudential criteria to determine whether or not the right to a reasonable term has been violated. However, noting that the criterion called “evaluation of the seriousness of the damage“ is not duly delimited, the present investigation seeks to specify the type of damage to be taken into account, as well as to incorporate the criterion “conduct of the representatives of the Public Prosecutor's Office“ since it is not possible to limit it only to the conduct of the judicial authorities, when the investigation period in the criminal proceeding is directed by the representative of the Public Prosecutor's Office.
