Abstract: El presente informe jurídico atiende a la necesidad de analizar la correcta
aplicación al deber de inocuidad alimentaria según lo establecido en el Código
de Protección al Consumidor. Es intención de la presente investigación analizar
si la Resolución No. 0398-2022/SPC-INDECOPI hizo una correcta aplicación a
los conceptos de inocuidad e idoneidad. De la misma forma, es objetivo del
presente informe identificar el bien jurídico protegido en el deber de inocuidad
alimentaria, así como establecer el alcance de la responsabilidad de los
proveedores en ella. A partir de ello, se ha hecho una investigación
jurisprudencias y doctrinaria para abordar los objetivos indicados. Como
resultado, el presente trabajo señala que la aplicación del deber de inocuidad en
los alimentos debe ser aplicada en virtud del criterio de especialidad a los casos
en los que nos encontremos ante un producto alimenticio que pueda ser nocivo
para la salud, por lo cual la Sala Especializada en Protección al Consumidor hizo
una correcta aplicación de la norma, salvo por la resolución del caso en cuestión,
según se indicará en el informe.
The present legal report addresses the need to analyze the correct application of the duty of food safety as established in the Consumer Protection Code. The intention of this investigation is to assess whether Resolution No. 0398- 2022/SPC-INDECOPI correctly applied the concepts of safety and suitability. Similarly, the objective of this report is to identify the legal interests protected under the duty of food safety, as well as to establish the scope of suppliers' responsibility in this regard. To achieve this, case law and doctrinal research have been conducted to address the aforementioned objectives. As a result, this work concludes that the application of the duty of food safety should consider a specialized approach in cases involving food products that may pose health risks. Therefore, the Specialized Consumer Protection Court correctly applied the norm, with the exception of the resolution of the specific case under review, as will be detailed in the report.
