This report analyzes Cassation No. 2720-2019 issued by the Permanent Civil Chamber of the Supreme Court of Justice of Lima, which resolves a cassation appeal filed for the normative violation of numerals 3 and 5 of article 139° of the Constitution of Peru, specifically consistent with numeral 2 of article 688° of the Civil Procedure Code. The analysis focuses on what was resolved by the judicial instances and what the Supreme Court finally ended up deciding on the actions of the judge and the parties during an award enforcement process against, in turn, the processing of an annulment action. Likewise, the defenses that the executed party can carry out against an executive order that has as its objective the fulfillment of the obligations contained in an arbitral award will be analyzed. Finally, the cases in which an arbitral award has the final quality will be analyzed and if this is necessary to execute an arbitral award, in accordance with the rules of our legal system.
