Abstract: El presente informe tiene interés jurídico por la relevancia de los temas que
aborda la Casación N° 1609-2019 – Moquegua. El caso implica el estudio de la
absolución del encausado Christian Mario Rospigliosi Mendoza como autor del
delito de Peculado doloso en agravio del Gobierno Regional de Moquegua, el
cual es analizado por la Corte Suprema en virtud del recurso presentado por el
despacho Fiscal Superior competente.
Se denunció que las instancias recurridas incurrieron en vulneraron el precepto
material y de la garantía de motivación, acorde al artículo 429, incisos 3 y 4 del
Código Procesal Penal. En ese sentido, el informe estudia la naturaleza jurídica
del Principio de Confianza, la aplicación de la teoría de infracción de deber en el
delito de peculado y sus consecuencias en la imputación objetiva. De manera
complementaria se analiza la afectación constitucional a la debida motivación
por ilogicidad e insuficiencia en la argumentación.
El informe plantea que las instancias recurridas interpretaron erradamente los
alcances y aplicación del Principio de Confianza en el delito de Peculado. Ello
produjo la exclusión de imputación del encausado en base a argumentos no
motivados como consecuencia de inferencias probatorias que no se
corresponden con fundamentos jurídicos desarrollados por la jurisprudencia, la
doctrina, y la razonabilidad exigible a la actuación jurisdiccional.
This report has legal interest due to the relevance of the issues addressed by Cassation No. 1609-2019 – Moquegua. The case involves the study of the acquittal of the accused Christian Mario Rospigliosi Mendoza as the author of the crime of intentional embezzlement to the detriment of the Regional Government of Moquegua, which is analyzed by the Supreme Court by virtue of the appeal presented by the competent Superior Prosecutor's office. It was reported that the appealed authorities committed a violation of a material provision and violation of the guarantee of motivation, in accordance with article 429, paragraphs 3 and 4 of the Criminal Procedure Code. In this sense, the report studies the legal nature of the Principle of Trust, the application of the theory of breach of duty in the crime of embezzlement and its consequences in objective imputation. In a complementary manner, the constitutional impact on due motivation due to illogicality and insufficiency in the argumentation is analyzed. The report states that the appealed authorities wrongly interpreted the scope and application of the Principle of Trust in the crime of Embezzlement as one of breach of duty. This meant the exclusion of the accused from being charged based on unmotivated arguments as a consequence of evidentiary inferences that do not correspond to legal foundations developed by jurisprudence, doctrine, and the reasonableness required of jurisdictional action.
