This legal report analyses Judgment no. 43835/11 issued by the European Court of Human Rights (HUDOC) where it assesses whether the French State's ban on the wearing of the full-face veil in public places violates the rights protected by the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), specifically, the right to respect for private and family life (Article 8); freedom of thought, conscience and religion (Article 9); freedom of expression (Article 10); and, separately and in conjunction with the aforementioned articles, the prohibition of discrimination (Article 14); freedom of thought, conscience and religion (Article 9); freedom of expression (Article 10); and, separately and in conjunction with the above-mentioned articles, the prohibition of discrimination (Article 14). The HUDOC in its ruling concludes that there is no violation of the ECHR by the French Republic. It is difficult to agree whit this ruling. It is considered that the principle of subsidiarity was not effectively use. Also too, an incorrect interpretation of the European consensus was made to grant wide margin of appreciation to the French State. In this way, the HUDOC avoid conducting the test of conventionality on the possible rights of the petitioner versus the State's interest.
