Una tarea pendiente : La inexistencia de un procedimiento general para la evaluación y calificación de la incapacidad para el trabajo

Abstract

La evaluación y calificación de la incapacidad para el trabajo es un medio para determinar si corresponde otorgar determinadas pensiones por incapacidad. En el Perú existen tantos procedimientos para la evaluación y calificación de la incapacidad para el trabajo como regímenes a cargo del otorgamiento de pensiones por incapacidad. En total son 3 regímenes bajo los cuales pueden brindarse las referidas pensiones. Cada procedimiento para evaluar y calificar la incapacidad se encuentra en un manual o en una directiva distinta, cada una de estas con marcadas particularidades que la diferencian de las otras. Este artículo tiene como finalidad identificar si existen situaciones problemáticas derivadas de la regulación actual de la evaluación y calificación de la incapacidad para en trabajo en el Perú y, de existir estas, brindar alternativas de solución. Para alcanzar el objetivo de este artículo, además de identificarse los procedimientos existentes, se analiza la actualidad de la evaluación y calificación para el trabajo en el Perú, de manera conjunta con lo que ocurre en Chile y Colombia.

The evaluation and qualification of incapacity for work is a means to determine whether certain disability pensions should be granted. In Peru there are as many procedures for the evaluation and qualification of incapacity for work as there are regimes in charge of granting disability pensions. In total there are 3 regimes under which such pensions can be granted. Each procedure for evaluating and qualifying the disability is contained in a different manual or directive, each of these with marked particularities that differentiate it from the others. The purpose of this article is to identify whether there are any problematic situations arising from the current regulation of the evaluation and qualification of incapacity for work in Peru and, if so, to provide alternative solutions. In order to achieve the objective of this article, in addition to identifying the existing procedures, the current situation of the evaluation and qualification for work in Perú is analyzed, together with what is happening in Chile and Colombia.
