The evaluation and qualification of incapacity for work is a means to determine whether certain disability pensions should be granted. In Peru there are as many procedures for the evaluation and qualification of incapacity for work as there are regimes in charge of granting disability pensions. In total there are 3 regimes under which such pensions can be granted. Each procedure for evaluating and qualifying the disability is contained in a different manual or directive, each of these with marked particularities that differentiate it from the others. The purpose of this article is to identify whether there are any problematic situations arising from the current regulation of the evaluation and qualification of incapacity for work in Peru and, if so, to provide alternative solutions. In order to achieve the objective of this article, in addition to identifying the existing procedures, the current situation of the evaluation and qualification for work in Perú is analyzed, together with what is happening in Chile and Colombia.
