Abstract: El presente trabajo académico de investigación tiene como objetivo general: identificar
cual es el mecanismo procesal adecuado en virtud del cual se puede cuestionar la falta
de acta de conciliación extrajudicial en el proceso civil a su vez poder analizar la
idoneidad del cuestionamiento de las excepciones procesales y proponer una fórmula
de solución. El método de estudio empleado es el Hermenéutico, se utilizó la técnica
del análisis documental. Se formuló como pregunta de investigación ¿Cuál es el
mecanismo procesal adecuado en virtud del cual se puede cuestionar la falta de acta
de conciliación extrajudicial en el proceso civil?
Se arribo como principal conclusión que: El mecanismo procesal adecuado en virtud
del cual se puede cuestionar la falta del acta de conciliación en el proceso civil, es una
excepción procesal debiendo de denominarse “excepción de falta de interés para obrar
por falta de conciliación extrajudicial”, ubicándolo en el artículo 446 inciso 11 del
código procesal civil y Se determino que también debe existir una excepción
denominada “excepción de falta de interés para obrar” para poder cuestionar en su
modalidad genérica al interés para obrar.
The general objective of this academic research work is to identify the appropriate procedural mechanism by virtue of which the lack of an extrajudicial conciliation act in the civil process can be questioned, while being able to analyze the suitability of the questioning of the procedural exceptions and propose a solution formula. The study method used is the Hermeneutic, the technique of documentary analysis was used. It was asked as an investigative question. The main conclusion is that: The appropriate procedural mechanism by virtue of which the lack of the act of conciliation in civil proceedings can be questioned, is a procedural exception and must be called “exception of lack of interest to act due to lack of extrajudicial conciliation“, placing it in article 446, paragraph 11, of the Code of Civil Procedure and It is determined that there must also be an exception called “exception of lack of interest to act“ in order to be able to question in its generic form the interest to act.
