Abstract: El proceso civil peruano no proporciona suficientes herramientas para garantizar una tutela
específica de los derechos materiales. Muchas veces, la tutela por equivalente se configura
como la solución a todos los males y se olvida uno de los fines principales del proceso:
otorgar al titular de un derecho, el mismo resultado o uno equivalente al que se hubiese
producido si no habría surgido el conflicto de intereses. No obstante, la realidad actual
demuestra que el proceso es instrumental al derecho material y la doctrina es unánime en
afirmar ello. Así, para garantizar el derecho a la tutela jurisdiccional efectiva y,
consecuentemente, una protección específica de los derechos, se hace necesario que,
frente a una situación en la que haya que recurrir al proceso, se posean instrumentos que
otorguen al titular de la situación de ventaja, la más específica y adecuada tutela.
En ese sentido, este trabajo tiene como propósito analizar y profundizar en el estudio de las
medidas coercitivas como actos ejecutivos, y su papel en la obtención de tutela específica,
evaluando su posible implementación en el proceso civil peruano. Para ello, la investigación
aborda la necesidad preponderante de reformar la ejecución civil peruana, con el objetivo de
incorporar medidas coercitivas que respondan a las exigencias contemporáneas de una
tutela jurisdiccional efectiva y adaptada a las situaciones materiales. A través de un análisis
dogmático y comparativo, se evidencia la importancia de una adopción gradual y contextual
de estas herramientas, que armonice la efectividad de la tutela jurisdiccional con las
particularidades del contexto peruano.
The Peruvian civil process does not provide enough tools to guarantee specific protection of material rights. Often, equivalent protection is configured as the solution to all problems, forgetting one of the main purposes of the process: to grant the holder of a right the same outcome or one equivalent to what would have occurred if the conflict of interest had not arisen. However, current reality shows that the process is instrumental to material rights, and the doctrine unanimously affirms this. Thus, to guarantee the right to effective judicial protection and, consequently, specific protection of rights, it is necessary that, when faced with a situation where the process must be invoked, there are instruments that grant the holder of an advantageous situation the most specific and appropriate protection. In this regard, the present work aims to analyze and delve into the study of coercive measures as executive acts, and their role in obtaining specific protection, evaluating their possible implementation in the Peruvian civil process. To this end, the research addresses the overriding need to reform Peruvian civil execution, with the main goal of incorporating coercive measures that meet contemporary demands for effective judicial protection adapted to material situations. Through a dogmatic and comparative analysis, the importance of a gradual and contextual adoption of these tools is highlighted, harmonizing the effectiveness of judicial protection with the particularities of the Peruvian context.
