Abstract: El presente informe jurídico tiene como finalidad realizar un análisis sobre la Resolución
Nº 2758-2019/SPC-INDECOPI, mediante la cual se establece que La Rosa Náutica S.A.
incurrió en la comisión de la infracción por trato discriminatorio, tipificado en el artículo
38.1° del Código de Protección y Defensa al Consumidor. Es así que, como se pasará
a desarrollar, la Sala Especializada de Defensa de la Competencia utiliza como
referente el cambio de criterio jurisprudencial emitido por la Resolución Nº 2025-
2019/SPC-INDECOPI a fin de determinar si a partir de los hechos expuestos por la
denunciante, se ha configurado un acto discriminatorio o un trato diferenciador ilícito
contra las mujeres consumidoras. En esa línea, no puede dejar de analizarse el
principio-derecho a la igualdad con el propósito de determinar si el acto en cuestión
quebranta el mismo, lo cual demostraría que no se ha dado un trato igualitario entre los
consumidores. Finalmente, como tercer tema jurídico del presente informe abordaremos
el rol que tienen las asociaciones de consumidores en nuestra sociedad, toda vez que,
el presente procedimiento fue iniciado a través de la denuncia interpuesta por la
Asociación de Consumidores Indignados Perú.
The purpose of this legal report is to analyze the Resolution Nº 2758-2019/SPCINDECOPI, whereby it is established that La Rosa Náutica S.A. incurred in the commission of the infringement for discriminatory treatment typified in article 38.1º of the Code of Consumer Protection and Defense. Thus, as will be developed below, the Specialized Chamber for the Defense of Competition uses as a reference the change of jurisprudential standards issued by Resolution Nº 2025-2019/SPC-INDECOPI in order to determine whether, based on the facts set forth by the plaintiff, a discriminatory act or an unlawful differentiating treatment against women consumers has been configured. In this line, the principle-right to equality cannot be left unanalyzed in order to determine whether the act in question violates it, which would demonstrate that there has not been equal treatment among consumers. Finally, the third legal issue to be dealt with in this report is the role of consumer associations in our society, since the present proceeding was initiated through a complaint filed by the Asociación de Consumidores Indignados Perú.
