Abstract: El presente informe buscar determinar si la empresa Válvulas Panamá cometió
actos de competencia desleal en la modalidad de actos de confusión e infracción
a la cláusula general en contra de Válvulas Perú, toda vez que estaría imitando
su oferta comercial en el mercado, así como habría hecho uso del personal de
dicha empresa para mejorar su posición competitiva. Para arribar a una
respuesta, se ha explorado, por un lado, el marco doctrinario de los actos de
confusión, así como los efectos de posibles conductas desleales realizadas en
el extranjero que puedan tener incidencia en el territorio peruano. Asimismo,
surgieron cuestionamientos respecto de las competencias de la Comisión de
Signos Distintivos y la Comisión de Fiscalización de la Competencia desleal para
conocer actos de confusión en los que se encuentran involucrados bienes
intelectuales. En lo que respecta a la infracción de la cláusula general, se analizó
si la conducta desplegada por Válvulas Panamá cumplía con lo dispuesto en la
norma para que proceda la configuración de este tipo infractor. Y, de ser el caso,
correspondía determinar si la Resolución 0140-2023/SDC-INDECOPI se
encontraba incursa en alguna causal de nulidad. Para dar respuesta a todas las
interrogantes surgidas, se recurrió a diferentes fuentes académicas sobre la
materia, así como doctrina pertinente emitida por la Sala de la Defensa de la
Competencia Desleal. Fue así como se concluyó que efectivamente sí se habría
incurrido en actos de competencia desleal en contra de Válvulas Perú.
This report determines whether the company Válvulas Panamá committed acts of unfair competition in the form of acts of confusion and infringement of the general clause against Válvulas Perú, since it would be imitating its commercial offer in the market, as well as having made use of the company's personnel to improve its competitive position. To arrive at an answer, it has been explored, on the one hand, the doctrinal framework of the acts of confusion, as well as the effects of possible unfair conduct carried out abroad that may have an impact on the Peruvian territory. Likewise, questions were raised regarding the competences of the Commission of Distinctive Signs and the Commission for the Control of Unfair Competition to hear acts of confusion involving intellectual property. Regarding the infringement of general clause, it was analyzed whether the conduct deployed by Válvulas Panamá complied with the provisions of the rule to proceed with this type of infringement. And, if so, it was necessary to determine whether the Resolution 0140-2023/SDC-INDECOPI was incurred in any grounds for invalidity. In order to answer all the questions that arose, different academic sources on the matter were consulted, as well as the relevant doctrine issued by the Chamber for the Defense of Unfair Competition. Thus, it was concluded that indeed there had been acts of unfair competition against Válvulas Perú.
