Abstract: El informe tiene como fin el análisis de la sentencia del caso de Ana Estrada y la
inaplicación del artículo 112 del Código Penal, para permitir la eutanasia y la
regulación de su ejecución. El tema abordado en la sentencia es trascendente
porque expone como un artículo como el citado entra en conflicto acerca de los
derechos fundamentales y las acciones que tiene el Estado al respeto. Al abordar
un procedimiento como la eutanasia, se crean problemas legales y éticos que
involucran derechos y deberes del Estado y sus instituciones con respecto a Ana
Estrada
.
Para analizar el sustento de dicho pedido y lo resuelto por el juzgado, se evalúan
las cuestiones procesales acerca del proceso de amparo y el ejercicio del control
difuso para permitir la inaplicación de la norma. Esto nos lleva a examinar la
Constitución, su Código Procesal, así como el resto de normativa pertinente
nacional.
Para abordar el análisis de fondo, focalizaré en las resoluciones de la Corte
Constitucional colombiana, destacando también los pronunciamientos del
tribunal ecuatoriano y español. Asimismo, se incorporará una perspectiva
nacional, con énfasis en las normativas y jurisprudencias peruanas.
La conclusión a la que se arriba es que la inaplicación del artículo mencionado
es válida, y, por tanto, que se permita la eutanasia; así como que la muerte digna
es un derecho fundamental que avala el pedido de Ana Estrada.
The purpose of the report is to analyze the sentence in the case of Ana Estrada and the non-application of article 112 of the Penal Code, to allow euthanasia and the regulation of its execution. The issue addressed in the ruling is transcendent because it exposes how an article like the one cited conflicts with fundamental rights and the actions that the State has to respect. When addressing a procedure such as euthanasia, legal and ethical problems are created that involve the rights and duties of the State and its institutions with respect to Ana Estrada. . To analyze the basis for said request and what was resolved by the court, the procedural issues regarding the protection process and the exercise of diffuse control will be evaluated to allow the non-application of the rule. This leads us to examine the Constitution, its Procedural Code, as well as the rest of the relevant national regulations. To address the background analysis, I will focus on the resolutions of the Colombian Constitutional Court, also highlighting the pronouncements of the Ecuadorian and Spanish courts. Likewise, a national perspective will be incorporated, with emphasis on Peruvian regulations and jurisprudence. The conclusion reached is that the non-application of the aforementioned article is valid, and, therefore, that euthanasia is allowed; as well as that a dignified death is a fundamental right that supports Ana Estrada's request
