Abstract: La presente tesis plantea analizar un supuesto de esquirolaje interno, al cual
denominaremos esquirolaje interno “impropio”, ello porque la acción de sustitución la
asumen, por voluntad propia, los trabajadores que no se encuentran dentro del ámbito de
la huelga – trabajadores no huelguistas, con ese fin, desarrollaremos como esta figura se
materializa en el escenario de una huelga legal y concretamente, estableceremos si la
responsabilidad de este acto contrario al derecho de huelga, le puede ser atribuible al
empleador.
Para ello, como parte de un marco teórico previo, identificaremos conceptos importantes
respecto al derecho de huelga, así como algunas reflexiones vinculadas entre este derecho
y la libertad de empresa, advirtiendo algunos hechos adoptados por el empleador frente
al desarrollo de una huelga que naturalmente, le genera un daño. Asimismo, analizando
el alcance de los efectos de la huelga, definiremos que derechos les corresponden a los
trabajadores no huelguistas, en ese escenario de conflicto.
Luego, a partir del poder de dirección propio del empleador, identificaremos conceptos
esenciales relacionados a las facultades del empleador como titular de la organización
productiva, para así, plantear que el empleador es responsable de todo acto contrario al
derecho de huelga, más aún si proviene de sus trabajadores, en tanto, al tener la
conducción y dirección de sus actividades, debe adoptar una conducta diligente y activa,
evitando que se realice cualquier actividad que pueda ser contraria al derecho de huelga
y a los efectos que de ella deriven.
Como complemento, examinaremos el esquirolaje interno “impropio” como una
infracción administrativa a la luz del principio de culpabilidad, específicamente en
relación a los principios de la personalidad de las sanciones y la exigencia de dolo o culpa.
This thesis aims to analyze a case of internal scab, referred to here as “improper“ internal scab. This term is used because it involves the substitution action taken voluntarily by workers who are not part of the strike, referred to as non-striking workers. The primary objective is to investigate whether the responsibility for this action, which contradicts the right to strike, can be attributed to the employer. To achieve this goal, we will first establish a theoretical framework by identifying key concepts related to the right to strike. We will also explore the interconnectedness of this right with the freedom of business, taking into consideration actions taken by the employer during a strike that may naturally result in harm. Additionally, we will analyze the rights afforded to non-striking workers within this conflict scenario. Subsequently, we will delve into the employer's managerial authority, highlighting essential concepts related to their role as the head of the productive organization. Our objective is to argue that the employer should be held accountable for any actions that go against the right to strike, particularly if these actions are undertaken by their employees. Given their responsibility for guiding and overseeing the activities of their workforce, employers should exercise due diligence and actively prevent any activities that contravene the right to strike and its potential consequences. To supplement this examination, we will scrutinize “improper“ internal scabbing as an administrative offence in light of the principle of culpability, with a specific focus on principles of sanctions and the requirement of intent or guilt related to this phenomenon.
