Abstract: La presente investigación es un breve análisis sobre la aplicación del artículo 97° del
código penal en el marco de un proceso cautelar seguido dentro de la Resolución N° 1,
del Expediente N° 00243 -2017-88-5001-JR-PE-01. Al respecto el citado dispositivo
normativo ofrece una interesante aproximación al derecho a la reparación y la efectividad
de las resoluciones judiciales, ofreciendo una aplicación similar a la acción pauliana del
código civil. En dicho contexto esta investigación aborda la relación del derecho a la
reparación, la presunción de inocencia, estándares probatorios y el derecho de motivación
de las resoluciones judiciales.
En dicho sentido, a través del análisis de la Resolución N° 1 se ha pretendido pretendemos
aportar de alguna manera al adecuado entendimiento de las pretensiones civiles en sede
penal, su correcta aplicación dentro de la tutela cautelar y como el derecho de inocencia
requiere que se superen ciertos estándares probatorios mínimos con el objeto de no dejar
en estado de indefensión a los particulares, o hacerlos soportar cargas que resulten
arbitrarias
This investigation is a brief analysis of the application of Article 97 of the penal code in the framework of a precautionary process followed within Resolution No. 1, of File No. 00243 -2017-88-5001-JR-PE-01. In this regard, the aforementioned normative device offers an interesting approach to the right to reparation and the effectiveness of judicial decisions, offering a similar application to the Paulian action of the civil code. In this context, this research addresses the relationship of the right to reparation, the presumption of innocence, evidentiary standards and the right to motivate judicial decisions. In this sense, through the analysis of Resolution No. 1 it has been intended that we intend to contribute in some way to the proper understanding of civil claims in criminal courts, their correct application within the precautionary protection and how the right of innocence requires that it be exceed certain minimum evidentiary standards in order not to leave individuals defenseless, or make them bear arbitrary burdens
