In this article, the discussion related to the admission of the participation of the extraneus in the crime of incompatible negotiation is addressed and it is argued that this is possible in certain cases. To do this, a brief review of the elements of the crime in question is previously carried out, noting that its indirect commission constitutes a first approach to the subject of concern to this article. This, because it puts on the table the scenario in which the competent public official carries out the criminal conduct through other agents. Subsequently, the pronouncements of the Supreme Court and works of the national doctrine that study the crime of incompatible negotiation are analyzed, thus finding the following: a first group of positions that does not expressly rule out the participation of the extraneus in the aforementioned crime, a second group that does not admit it and a third group, that admitting it, does so with certain particularities. Having reviewed the above, responses and observations are made to each of the objections and arguments against or in favor of the position of the article. Finally, a personal proposal is presented on the cases in which it is possible to calmly admit participation in the crime of incompatible negotiation: scenarios in which the extraneus is not the subject with whom the State negotiates within the framework of a process state contracting.
