Abstract: El presente Informe analiza la Sentencia de Inconstitucionalidad recaída en el
Expediente No. 023-2009-PI/TC, interpuesta por el señor Gonzalo Tuamana
Tuamana (en representación de 5000 ciudadanos), contra el Decreto Legislativo No.
1079.
Este Decreto, establece mecanismos de tutela de las Áreas Naturales Protegidas y
regula las competencias del Servicio Nacional de Áreas Naturales Protegidas SERNANP.
Por ello, se analizará normativa interna, instrumentos internacionales, doctrina y
jurisprudencia emitida por la Corte Interamericana de Derechos Humanos, así como
por el máximo Tribunal de otros países de la región.
En base a lo descrito, plantearé mi postura respecto a la constitucionalidad del
presente Decreto, con la finalidad de identificar si se debió realizar el proceso de
consulta previa a los pueblos indígenas antes de emitir este Decreto.
Al respecto, es necesario comprender el sistema que regula a estas áreas, por lo cual
las describiré, con la finalidad de demostrar que este Decreto no afectó materialmente
a los pueblos indígenas que habitan en ellas.
Finalmente, analizaré el derecho a la consulta previa contenida en el Convenio 169
de Organización Mundial del Trabajo con la finalidad de identificar su contenido y
alcances, lo que permitirá reafirmar mi postura respecto a la constitucionalidad de
este Decreto.
This report analyzes the Unconstitutionality Ruling in Case No. 023-2009-PI/TC, filed by Mr. Gonzalo Tuamana Tuamana (on behalf of 5000 citizens), against Legislative Decree No. 1079. This Decree establishes mechanisms for the protection of Natural Protected Areas and regulates the competencies of the National Service of Natural Protected Areas - SERNANP. Therefore, we will analyze internal regulations, international instruments, doctrine and jurisprudence issued by the Inter-American Court of Human Rights, as well as by the highest Court of other countries in the region. Based on the above, I will present my position regarding the constitutionality of this Decree, in order to identify whether the process of prior consultation with indigenous peoples should have been carried out before issuing this Decree. In this regard, it is necessary to understand the system that regulates these areas, for which I will describe them, with the purpose of demonstrating that this Decree did not materially affect the indigenous peoples that inhabit them. Finally, I will analyze the right to prior consultation contained in Convention 169 of the World Labor Organization in order to identify its content and scope, which will allow me to reaffirm my position regarding the constitutionality of this Decree.
