In our country, there are different types of special labor regimes established according to the economic capacity of employers, which has given rise, for example, to the special regime for Micro and Small Enterprises. However, this situation has not occurred with non-profit legal entities, which, as they are excluded from said regime, provide a differentiated treatment, as their economic capacity and legal purpose are not taken into account. Under this context, the main objective of the present investigation is to identify if there is an effect on the principle-right of equality, since a special labor regime is not regulated in favor of non-profit legal persons that allows them to enjoy benefits in the payment of their labor obligations, as is the case with micro and small businesses, employers of domestic workers and other employers without legal personality, which in some cases do not pursue an economic or lucrative purpose either; using the qualitative-descriptive method in the analysis. The research, using the equality test, concludes that the lack of regulation of a special regime in favor of non-profit legal entities violates their right to equality before the law.
