The main problem of this academic project, is to determine, if, it’s constitutionally valid to apply the causes of vacancy directed to the Mayor (LOM) and the causes of vacancy of Regional Governor (LOGR), to the Mayor of the metropolitan municipality of Lima, taking into account whether his conduct fits inside an attribution included in the LOGR or the LOM? So, the objective of this work is to determine which is the correct legal application for the mayor of the MML, taking into account its special regime characteristic, and, consequently, determine which is its legal nature and applicable legal regime, basing our analysis on what has been developed by the defense of the vacancy case to Mr. Muñoz. In that sense, we affirm that it is not constitutionally valid to apply the causes of vacancy included in the LOM and the LOGR in an indistinct way, even when the conduct of the mayor of the MML fits inside of a power included in the LOGR, because, although the MML develops regional functions as well, the truth is that mayor of the MML can not be considered as a regional governor, since, the mayor of the MML does not have the legal status of regional governor, but rather only as mayor, therefore, the causes of vacancy that are applied to him, will always be those ones that are included in the article 22 of the LOM, and under no circumstances could be applied the ones that are in the LOGR.
