Abstract: El presente informe analiza el concepto de duda justificada sobre la
independencia e imparcialidad de un árbitro, en el marco de un caso de anulación
de laudo por las causales b) y c) del artículo 63 del decreto legislativo 1071, para
a partir de ello esbozar que el criterio para concretizar el concepto de duda
justificada a razón de un vínculo amical requiere emplear los elementos de
proximidad e intensidad del vínculo al momento de efectuar el deber de
revelación para la evaluación realizada por las partes.
Para estos fines hemos recurrido a la legislación nacional sobre el arbitraje, las
guías de buenas prácticas en el arbitraje, así como el análisis de sentencias que
desarrollan el concepto de duda justificada sobre la independencia e
imparcialidad de un árbitro (como es por ejemplo la resolución N° 43 del
expediente N° 155-2012 de la Corte Superior de Justicia de Lima y la Sentencia
del Tribunal Constitucional recaída en el expediente N° 02851-2010-PA/TC) y
decisiones internacionales sobre recusaciones (ICSID Case ARB03/19).
De igual forma, se analizó el desarrollo realizado por la doctrina de la
imparcialidad e independencia y sus elementos (autores como Mario Castillo
Freyre, Esteban Alva, Julio Wong, Francisco González de Cossío, Thomas Clay,
Joshi Riddi, Marlen Estévez, entre otros).
The present study analyzes the concept of justified doubt as to the independence and impartiality of an arbitrator, in the context of a case of annulment of an award on the grounds b) and c) of Article 63 of Legislative Decree 1071, in order to outline that the criterion for determining the concept of justified doubt on the basis of a friendly relationship requires the use of the elements of proximity and intensity of the relationship at the time of making the duty of disclosure for the assessment made by the parties. For these purposes, we have resorted to the national legislation on arbitration, the guides to good practice in arbitration, as well as the analysis of judgments that develop the concept of justified doubt on the independence and impartiality of an arbitrator (such as, for example, Resolution No. 43 of Case No. 155-2012 of the Superior Court of Justice of Lima and the Constitutional Court's judgment in Case No. 02851-2010-PA/TC) and international decisions on challenges (ICSID Case ARB03/19).
