Abstract: La finalidad de este artículo jurídico es evidenciar que el Estado y las entidades
públicas, a nivel nacional, también pueden ser representadas y defendidas por algún
abogado-apoderado que designe el titular de cada entidad y no solo por el procurador
público. De esta manera, se busca establecer que, en determinados casos, es
jurídicamente viable que algunas entidades públicas que no cuentan con procurador
público por diversos motivos puedan intervenir directamente en las investigaciones,
procesos o procedimientos, jurisdiccionales y no jurisdiccionales, cualquiera sea su
naturaleza y/o materia, a través de un abogado-apoderado que acredite el titular de la
institución.
The purpose of this legal article is to show that the State and public entities, at the national level, can also be represented and defended by a lawyer-attorney designated by the head of each entity and not only by the public attorney. In this way, it seeks to establish that, in certain cases, it is legally viable that some public entities that do not have a public attorney for various reasons can intervene directly in investigations, processes or procedures, jurisdictional and non-jurisdictional, whatever their nature and /or matter, through a lawyer-representative who certifies the owner of the institution.
