To participate in the market, economic agents adopt different strategies and forms of organization to make their offer stand out from those of their competitors. This includes, of course, the type of business model. This is also true in the film industry. However, a few years ago, INDECOPI, through the Specialized Chamber for Consumer Protection, issued Resolution No. 243-2018/SPC-INDECOPI, whereby it sanctioned Cinemark with a reprimand for infringing Article 50, Literal e), of the Code of Consumer Protection and Defense by establishing that consumers who have purchased a ticket to attend the screening of a movie in its facilities may enter the movie theaters with food that has not been purchased in its confectionery area. That is why, in this legal report, we will not only analyze the substantive discussion on the commission of the infringement, establishing as a prior question the role of INDECOPI as a protector of consumers and the proper development of the competitive process, but we will also discuss formal aspects of the administrative sanctioning procedure regarding the imputation made at the beginning and the sanction and corrective measure imposed towards the end. For this purpose, we have made a study of doctrinal and legislative sources, as well as pronouncements of the public administration and the jurisprudence of the Constitutional Tribunal.
