Abstract: El presente versa sobre una controversia sometida a arbitraje entre el Consorcio de Alimentos SAC
(en adelante, EL CONTRATISTA) y el Programa Nacional de Asistencia Alimentaria (en adelante, LA
ENTIDAD).
La controversia surge cuando uno de los medios de transporte en los que llevaba EL CONTRATISTA
el producto papilla para la entrega a LA ENTIDAD, sufre un accidente y como consecuencia no puede
cumplir con la entrega en el tiempo pactado, se detectan bolsas rotas, con fechas borradas, así como
bolsas sucias con muestras de haberse mojado, etc., y ante una inmovilización del producto en los
almacenes de LA ENTIDAD realizada por la Fiscalía de Prevención del Delito y remitiendo una
muestra a DIGESA para su verificación, ésta da como resultado no apto para el consumo humano,
siendo así que LA ENTIDAD no efectúa el pago correspondiente.
Dado el no pago, EL CONTRATISTA procede a resolver el contrato suscrito con LA ENTIDAD y recurre
a la vía arbitral para reclamar el mismo, aplicando la cláusula arbitral contenida en el suscrito.
En la vía arbitral, EL CONTRATISTA solicita como pretensión que se le pague la factura pendiente, en
segundo lugar, que se reconozca el pago de una indemnización por daños y perjuicios, aspectos que
van a ser analizados en adelante. Asimismo, analizaremos el proceso arbitral, si se cumplió con los
parámetros de éste, las pretensiones que se solicitaron, si fueron correctamente formuladas, así
como la posición del Tribunal Arbitral.
