It is known that it is the duty of the judge to issue a duly justified sentence that explains the reasons involved in adopting one or another decision. For this purpose, it has been detected in the case of food (above all) that the use of the maxims of experience is used daily, in that effort; In principle, our purpose is to provide the various meanings of “experience maxims“, to take a position regarding a definition and minimum structure that allows us to understand its identification in a case, its scope, and its effects. Then we will present the civil process for food as a highly flexible type, which allows specifying values of the fundamental right to food and specifying the best interests of the child and adolescent. Immediately it corresponds to have an understanding of what it implies to justify a decision and finally to present some cases, which show an obtuse way of presenting arguments to justify a possible use of maximum experience.
