This report analyses the ruling in Case No. 05048-2016-PA/TC of the Peruvian Constitutional Court, which analyses the situation of persons with disabilities in the medical field, specifically with regard to their hospitalization. In this sense, institutions such as legal capacity, informed consent and not being deprived of personal liberty for reasons of disability are rights recognised by the Convention on the Rights of Persons with Disabilities since it entered into force. In this manner, given that the Peruvian State has ratified the Convention, the present paper develops the fact that certain grounds of the Constitutional Court on the case in question go against the international obligations contracted, violating not only the rights now acquired by persons with disabilities in the framework of the social model for defining and understanding disability, but also reinforcing the structural and intersectional discrimination that this sector of the population has been going through historically. In this way, in addition to addressing the legislative overview of the legal status of persons with disabilities, this paper also places special emphasis on the attitudinal and systemic barriers not only in terms of the administration of justice, but also in relation to citizens and medical professionals.
