Creación de una fiscalía especializada contra el sicariato por su alta incidencia en el ámbito de Piura observada durante los años 2017-2021

Abstract

El sicariato definido jurídicamente como la perpetración de muerte por encargo, se ha incrementado en Piura; reflejando una “Alta incidencia del sicariato, en el ámbito de Piura durante los años 2017-2021” en ascenso continuado, el sujeto activo denota violencia y peligrosidad para la extinción de la vida humana, atentando contra este derecho humano fundamental permanente de manera irreversible. Esta realidad constituye un problema público de afectación directa a la sociedad piurana, referente aciago para las actividades económicas en sus tres sectores, impacto nocivo para Piura. Las organizaciones y bandas criminales extorsionan cobrando cupos y exigiendo cuotas laborales en obras de construcción e infraestructura. Por otro lado, solicitan dinero por “seguridad” (chalequeo) donde subyacen otros delitos, mostrando control o hegemonía de la zona, a través del sicariato eliminan a sus “competidores”. Absolviendo las Áreas del Problema y la Solución Innovadora; se infiere que hay una inconsistencia en la investigación del sicariato, la fiscalía penal mediante la noticia policial lo asume durante su turno (4 días); sin embargo, en este periodo debido a su carga funcional optan por requerir el informe policial hasta su retorno a la DIVINCRI Piura como carpeta fiscal con disposiciones para actos de investigación en un tiempo de su libre disposición. Como instrumento aplicable de solución innovadora se ha propuesto la creación de una Fiscalía Especializada contra el Sicariato-Homicidio Calificado para el distrito fiscal de Piura y Sullana, para una adecuada articulación-coordinación y consistencia de la investigación.

As an applicable instrument of innovative solution, the creation of a Specialized Prosecutor's Office against Hiring-Qualified Homicide for the tax district of Piura and Sullana has been proposed, for adequate articulationcoordination and consistency of the investigation
