Abstract: El presente informe jurídico tiene como objetivo analizar el caso materia de la
Resolución N° 825-2023-SUNAFIL/TFL-Primera Sala, sobre si la no asignación
de labores de trabajo, durante la suspensión imperfecta de labores, se configura
como un acto de hostilidad que puede afectar la dignidad de la trabajadora.
Lo particular de este caso es que, durante la revisión de los hechos, previo a la
no asignación de labores efectivas, concurren otros actos que afectan derechos
fundamentales de la trabajadora, los cuales no han sido advertidos y, por ende,
no han sido considerados como conductas infractoras pasibles de sanción.
De este modo, el análisis plantea la evaluación de las conductas infractoras no
advertidas por el inspector, de modo que determinaremos si, en el presente caso,
concurren otros actos de hostilidad que afectan otros derechos de la trabajadora.
The objective of this legal report is to analyze the case subject to Resolution No. 825-2023-SUNAFIL/TFL-First Chamber, on whether the non-assignment of work tasks, during the imperfect suspension of work, is configured as an act of hostility that can affect the dignity of the worker. The particular thing about this case is that, during the review of the facts, prior to the non-assignment of effective tasks, other acts occur that affect the fundamental rights of the worker, which have not been warned and, therefore, have not been considered. as offending behaviors subject to sanctions. In this way, the analysis proposes the evaluation of the offending behaviors not noticed by the inspector, so that we will determine if, in the present case, other acts of hostility occur that affect other rights of the worker.
