On September 20th, 2020, the VIII Pleno Casatorio Civil was published. In this ruling, the Supreme Court determined that the legal act of disposition of assets of the marital partnership, in which only one of the spouses intervenes, is null. Thus, this legal report analyzes the implications of the Supreme Court's decision on the parties of the legal act, the spouse who did not intervene and possible third parties. It also analyzes the effects of the nullity of the legal act in a registry scope, which also implies determining whether or not there is any affectation to the third party who contracts under the parameters established by article 2014 of the Civil Code In addition, it is intended to give its own assessment as to whether the legal act of disposition of matrimonial property, carried out by only one spouse, is null, voidable or ineffective. From this analysis, based on doctrine and jurisprudence, it is concluded that the ineffectiveness thesis is the most appropriate, not only because the absence of one of the spouses in the act constitutes a lack of legal standing, but also because this thesis safeguards the interests of all the participants in this act, including the spouse who did not intervene and the bona fide purchaser
