Abstract: El presente artículo a presentar gira entorno al ámbito de los servicios médicos
en el Perú, siendo el problema principal el deber de información esto respecto al
consentimiento informado, esto debido a que existe una practicidad muy común
entorno a ello, se ve este consentimiento como un simple trámite que lo único
que se desea obtener de ello es la firma del paciente y se asume con ello se ha
dado por concluido el consentimiento informado, pero ¿realmente existe un
entendimiento de ello? En muchos casos la respuesta es no. Además, también
existe el problema con el deber de idoneidad respecto a los dos tipos de
obligaciones que se dan, por un lado la obligación de medios y la obligación de
resultados. En lo que concierne a esto último es muy controversial, en lo que
concierne a cuál es la responsabilidad del médico en un tratamiento o
intervención quirúrgica, uno espera que pueda ser un resultado favorable, pero
por lo propio de los servicios médicos siempre existe una posibilidad de que no
siempre los resultados sean así. Por ello el objeto del presente artículo es lograr
obtener una recomendación que pueda ser empleado en la normativa en el
ámbito salud, esto por ejemplo al consentimiento informado y que pueda
entenderse que la idoneidad en muchos casos no solo es esperar que se reciba
de la manera más idónea, sino que sea brindada de acuerdo con los estándares
que media todo servicio médico idóneo.
The present article to present revolves around the field of medical services in Peru, being the main problem the duty of information regarding informed consent, this because there is a very common practicality around it, this consent is seen as a simple procedure that the only thing you want to get from it is the signature of the patient and it is assumed that this has concluded the informed consent, but is there really an understanding of it? In many cases the answer is no. In addition, there is also the problem with the duty of adequacy with respect to the two types of obligations that are given, on the one hand the obligation of means and the obligation of results. As far as the latter is concerned it is very controversial, as far as what is the responsibility of the physician in a treatment or surgical intervention, one hopes that it may be a favorable outcome, but because of the very nature of medical services there is always a possibility that the results may not always be so. Therefore, the purpose of this article is to obtain a recommendation that can be used in the regulations in the field of health, this for example to informed consent and that it can be understood that the suitability in many cases is not only expected to be received in the most suitable way, but to be provided in accordance with the standards that mediates all suitable medical service.
