Abstract: El aborto en el Perú está prohibido de manera parcial pues legalmente solo se
permite su práctica en determinados supuestos, como son el aborto terapéutico,
sentimental y eugenésico, regulados en los artículos 119 y 120 del Código Penal.
De dicho panorama se colige que la vida de las mujeres debe estar en riesgo para
que se les permita interrumpir sus embarazos, lo cual nos lleva a preguntarnos por
qué está penalizado el aborto libre, voluntario y legal en el Perú en el cual sean las
mujeres las que decidan cuándo solicitar un aborto. Así, este trabajo recoge aquella
interrogante y se plantea una pregunta específica: ¿por qué la regulación penal
menoscaba los derechos de las mujeres que desean interrumpir sus embarazos?
Como hipótesis, este trabajo sustenta que la regulación peruana del aborto se
construye como un castigo hacia las mujeres al dotar de validez absoluta al derecho
a la vida del embrión, desatendiendo que las mujeres son titulares del derecho al
libre desarrollo de la personalidad, a la salud, la integridad física y la integridad
psicológica, y a ser tratadas como fines y no medios e ignorando las
recomendaciones de organismos internacionales, los cuales se muestran a favor de
la despenalización del aborto. De esta manera, este artículo postula que la
regulación del aborto carece de fundamentos jurídicos, lesiona derechos de las
mujeres, simpatiza con las posturas provida y no es una medida idónea para el fin
legítimo de protección de los bienes jurídicos propios de un estado constitucional.
Abortion is partially legal in Peru due to the fact that it can only be done in some cases, such as a therapeutic, sentimental or eugenic abortion procedure, which can be found in articles 119 and 120 from the Penal Code. Such scenario suggests that the life of women must be in danger in order to ask for an abortion, which leads us to question why is it illegal to have a free, voluntary and legal abortion procedure in Peru, in which it would be women who choose whether to have it or not. So, this work picks up that question and constructs another one: why does the criminal law violate the rights of women who wish to have an abortion done? As a hypothesis, this narrative suggests that the peruvian regulation of abortion is actually a punishment for women as it gives absolute worth to the embryo and its right to live, while lacking to protect some of the following rights that women have: the right to the free development of personality, the right to health, the right to a physical and mental integrity, the right to not be treated as means to an end, meanwhile choosing to ignore the recommendations from international organisms which defend the decriminalization of abortion. So, this work explains that the regulation of abortion in Peru lacks of lawful arguments, violates the rights of women, sympathizes with prolife affirmations and is not suitable to achieve the aim of protection of legal assets common in a constitutional state of law.
