The aim of this article is to analyse the alleged pregnancy of Paola Guzmán Albarracín in the case of Guzmán Albarracín et al. v. Ecuador, the first case decided by the IACHR Court on gender-based violence in the private sphere, specifically in a public school. Thus, based on dogmatic research, through the study of legal rules, institutions or concepts that emanate from International Human Rights Law, the aim is to demonstrate that the IACHR Court had to apply the evidentiary standards constructed in its jurisprudence on genderbased violence in order to resolve the case. In addition, this paper proposes and explains the significant advance that it would have represented for the ISHR if the IACHR Court had applied these standards of evidence to a case of gender-based violence in the educational sphere. Specifically, it analyses, from an evolutionary perspective, the figures of: i) the inversion of the burden of proof and ii) indicative evidence, giving value to the structural, contextual and particular elements of the case. In order to do so, methodological and documentary tools will be used, without using qualitative and quantitative tools.
