In 2017, Law 30709 was approved, with which the elimination of situations of remuneration discrimination between women and men was sought, considering the application and effectiveness in remuneration matters of the principle of equal remuneration between women and men for work of equal value provided for in ILO Convention 100. On that date, statistical indicators showed that in Peru the wage gap between men and women was around 29.3%, a very high level. Therefore, the purpose of said rule was the progressive reduction of the levels of wage gap existing in our country; however, in 2021 the wage gap was 25.9%; Therefore, through this document we seek to analyze whether Law No. 30709 and its methodology, which establishes the determination of category and function charts and with respect to them, the application of the scoring system by objective criteria indicated In the norm, it is effective for achieving the elimination of salary discrimination and the effectiveness of the principle of equal remuneration between women and men for work of equal value. In this regard, we consider that the indicated methodology is not adequate to eliminate wage discrimination and achieve the effectiveness of the principle of equal remuneration between women and men for work of equal value, we consider that the appropriate path is to apply the methodology recommended by the ILO.
