The Traffic Accident Certificate (CAT) was created as a more economical alternative, compared to the Compulsory Traffic Accident Insurance (SOAT), for public transportation companies that need to contract an accident insurance policy to operate within the Peruvian territory. However, at present, the tendency is that in traffic accidents involving a public transportation vehicle, the victims are not adequately attended or compensated, despite the existence of the CAT. In view of this situation, the present research work seeks to analyze the figure of the AFOCAT by virtue of its nature and regulatory framework, in order to determine whether it is necessary to reform it in order to provide adequate protection to the users of such service: the victims of a traffic accident involving a vehicle engaged in public transportation. This is due to the fact that, compared to the SOAT, the CAT legislation is much more flexible, since it is not an insurance product, but a self-insurance that operates under the structure of a trust. This generates and allows certain distortions in the market that generate a detriment to the benefits of indemnity and/or care. Therefore, it is necessary to reform the CAT system or the Traffic Accident Funds Associations (AFOCAT), incorporating some elements of a parallel system: the SOAT.
