The Escazu Agreements is the first treaty on environmental matters. this treaty aims to ensure the Access to Information, Public Participation and Justice in Environmental Matters. Even thought, Peru has agreed to this treaty, it decided to reject its adoption formally. The reason was the lack of substance, due to the legal framework has already regulated its content. However, it is important to analyze its provisions in order to determine the impacts in our legal framework. Thus, we can conclude the necessity of its adoption. One of the key elements of the agreement is the environmental justice. This aims to give the necessary legal instrument to any person who suffers an environmental impact. Considering the relevance of the environmental justice, this article intends to analyze and compare the legal framework with the agreement in order to determine the benefits of it. As a result, we can observe that our current legal framework is one of the most advance compared to the region. Also, it has already incorporated some of the rules from the treaty. Besides, we can achieve the agreement purpose through infralegal regulations. For that reason, the adoption of the Escazu Agreement, responds to politics decisions, more than the environmental justice lack of legal protection.
