Abstract: Los temas por tratar en el presente trabajo se encuentran relacionados a la
Resolución N°0065-2022/SDC-INDECOPI, en la cual Grupo Acosta E.I.R.L (en
adelante, Grupo Acosta) interpuso una denuncia por la supuesta comisión de
actos de competencia desleal en la modalidad de denigración contra Audio
Tuning E.I.R.L (en adelante, Audio Tuning). Dicha denuncia versaba en que al
parecer Audio Tuning habría realizado una publicación vía red social Facebook
describiendo a los productos de la denunciante (de la marca “Black Hawk” y
“Hydra By Black Hawk”) como “burda copia” y calificando a la empresa que
comercializaba dichos productos como una “empresa inescrupulosa” y
“empresarios informales”.
Posteriormente, la Sala Especializada en Defensa de la Competencia revocó la
resolución de la Comisión, sustentando que sí existía una alusión inequívoca a
la denunciante, por tanto, correspondía declarar fundada la denuncia interpuesta
por Grupo Acosta.
En ese sentido, el presente informe jurídico tiene como principal finalidad el
verificar si existió un acto de competencia desleal en la modalidad de
denigración; por lo que nos concentraremos en desarrollar un análisis más
exhaustivo sobre qué implica la alusión inequívoca, ya que esta cumple con un
papel imprescindible para la configuración de actos de publicidad alusiva.
Conjuntamente, se analizarán otras modalidades de actos de competencia
desleal con la finalidad de calzar los hechos que se manifiestan en el presente
caso y concluir si estos concuerdan con otro acto de competencia desleal.
The issues to be discussed in this work are related to Resolution N°0065- 2022/SDC-INDECOPI, in which Grupo Acosta E.I.R.L (from now on, Grupo Acosta) filed a complaint for the alleged commission of acts of unfair competition in the modality of denigration against Audio Tuning E.I.R.L (from now on, Audio Tuning). Said complaint was that Audio Tuning had made a publication via the social network Facebook describing the complainant's products (branded as “Black Hawk” and “Hydra By Black Hawk”) as a “gross copy” and calling the company that marketed said products as an “unscrupulous company” and “informal entrepreneurs.” Subsequently, the Specialized Competition Defense Chamber revoked the Commission's resolution, maintaining that there was an unequivocal allusion to the complainant, therefore, it was appropriate to declare the complaint filed by the Acosta Group. In that sense, the main purpose of this legal report is to verify whether there was an act of unfair competition in the form of denigration; Therefore, we will focus on developing a more exhaustive analysis of what the unequivocal allusion implies, since it plays an essential role in the configuration of allusive advertising acts. Jointly, other acts of unfair competition will be analyzed to fit the facts that appear in the present case and conclude whether these agree with another act of unfair competition.
